User Responsibilities

Customers must ensure that their content complies with all legal regulations. Unauthorized activities, including spamming, hacking, or distributing illegal content, are strictly prohibited.

Service Suspension and Termination

HostPatch reserves the right to suspend or terminate services due to misuse or violations.

Payments and Refunds

All services are prepaid, with renewals required before expiration. Refunds are subject to our refund policy.

Liability Limitations

HostPatch is not liable for data loss or service interruptions beyond our control.

Privacy

We prioritize data protection. Review our Privacy Policy for more details.

Dispute Resolution

Disputes will be resolved per our dispute process.

 

General Rules of Conduct

Compliance with Laws

Users must comply with all applicable local, state, national, and international laws, including those related to content and service usage.

Prohibited Activities

You must not engage in illegal activities like hacking, phishing, child exploitation, violence, or promoting terrorism. Activities like spamming, distributing pirated software, or running illegal operations (e.g., warez, Ponzi schemes) are strictly prohibited.

User Content and Privacy

You may not collect personal data from other users without consent or breach any intellectual property rights. Misuse of others’ personal or confidential information is prohibited.

Security Obligations

You are responsible for maintaining the security of your account. Any attempt to bypass or disrupt HostPatch’s security measures or engage in activities such as introducing harmful software (e.g., viruses, Trojan horses) is prohibited.

Resource Usage

Excessive strain on infrastructure is forbidden, and misuse of server resources (CPU, RAM, bandwidth) that affects other users is not allowed.

False Information and Fraud

Users must not provide misleading information about HostPatch’s services or engage in deceitful or fraudulent activities. HostPatch reserves the right to suspend or terminate services for violations.

Prohibited Content and Materials

No hosting of illegal materials, including copyrighted works, warez, phishing, gambling, drugs, or any material violating laws.

Identity Verification

HostPatch may request government-issued identification for verification purposes.

Service Modification and Resale

You are not permitted to modify, reproduce, or distribute HostPatch services or website content without permission. Reselling services or bypassing HostPatch’s security measures is also prohibited.

Account Monitoring and Termination

HostPatch reserves the right to monitor accounts for suspicious or illegal activities. If fraud, abuse, or violations are detected, HostPatch may suspend or terminate accounts and pursue legal action.

Communications and Marketing Consent

By providing contact information, users consent to receive marketing communications from HostPatch, including automated calls and texts, subject to applicable laws.

 

Abuse of Resources

Illegal Use

HostPatch services are strictly for lawful activities. You may not transmit, store, or distribute any content that violates laws or regulations. This includes, but is not limited to, copyrighted material, obscene or defamatory content, or intellectual property used without proper authorization.

Spamming

Sending unsolicited bulk or commercial messages (spamming) over the internet is prohibited. HostPatch reserves the right to determine if any activity qualifies as spamming and take action.

System and Network Abuse

Violations of system or network security may result in civil or criminal liability. Examples of violations include unauthorized access to systems or networks, mail bombing, flooding, deliberate attempts to overload a system, and interference with services for any user or network.

Viruses and Malicious Activity

Use of HostPatch services to create or distribute harmful software such as viruses, worms, or Trojan horses is forbidden. This includes engaging in Denial of Service (DoS) attacks or other malicious activities like pinging, flooding, or mail bombing.

Pornography

It is forbidden to use HostPatch services to store, display, post, or transmit pornography. We will report any violation related to pornography to the appropriate law enforcement authorities.

Payment Terms

HostPatch reserves the right to suspend services if payments are not made by the due date. We are not responsible for any loss resulting from the disruption of services due to non-payment.

IRC

HostPatch does not permit the operation of Internet Relay Chat (IRC) or IRC bots on any web hosting or e-commerce accounts.

Anti-Piracy

You are prohibited from distributing illegal or pirated software or multimedia content. Any client found using pirated software will face immediate termination of services and will be liable for penalties under copyright laws.

Third-Party Software Liability

If you install any third-party software, you are fully responsible for ensuring its legality. In case of any dispute over software usage, you will be held liable for any legal consequences.

 

Bandwidth Regulations

Bandwidth Exceedance

If your account exceeds the allotted bandwidth limit, we will notify you. Should you choose not to purchase additional bandwidth or upgrade your account, your service will be suspended until you either upgrade or take steps to reduce your usage. Accounts will be reactivated at the beginning of the following month.

Normal Usage

We do not impose a strict bandwidth limit for personal or small business websites as long as they comply with our terms. However, if your usage or content threatens the stability, performance, or uptime of our servers and infrastructure, you may be required to upgrade to a VPS, or we may need to restrict your website’s resource usage.

 

HostPatch as a Reseller or Sub-licensor

Use of Third-Party Services

HostPatch may utilize third-party services, hardware, software, and equipment in its capacity as a reseller or sub-licensor.

Liability Disclaimer

We are not responsible for any modifications to these services that may render resold products outdated, including improvements that affect service output.

Defects and Failures

Any failures or defects in resold services, whether sold, sub-licensed, or provided to you, shall not be deemed a breach of HostPatch’s obligations under this agreement.

Rights Limitation

Your rights regarding any resold products are limited to those granted by the respective manufacturers.

Authorized Use

You are permitted to use any resold products provided by HostPatch solely in connection with the services outlined in this agreement.

Prohibited Actions

You may not attempt to clone, modify, reverse engineer, or tamper with any resold products, except as necessary for the use of services.

 

Bandwidth Regulations

Account Details

To access HostPatch services, you must create an account. Upon placing your order, you will receive a username and password, which we reserve the right to modify. Any changes will be communicated via your registered email. By setting up your account, you confirm that all information provided is accurate and complete. You are responsible for all activities on your account, so it is essential to keep your login credentials secure. Please notify us immediately of any unauthorized account access or security breaches.

 

Domain Registration

Domain Availability

We cannot guarantee the availability of any specific domain name you request for registration. The domain will always be registered or transferred in your name. You are responsible for managing your domain’s WHOIS data through your HostPatch client area. Ensure all contact information is accurate; failure to do so may result in your domain being taken offline. We may change the domain registrar at our discretion without prior notice.

Designated Agent Role

For all relevant gTLDs, you consent to our role as a Designated Agent according to ICANN’s Transfer Policy when updating registrant contact details linked to a domain. This authorizes us to approve changes to registrant information on your behalf.

Refund Policy

No refunds are applicable once a domain has been registered.

 

Domain Infringement

You are prohibited from registering a domain name that is similar to a trademarked domain or one that competes in a similar market. Registration of such domain names may result in liability for trademark infringement (e.g., amazonbuy.in, flipkartsales.com).

 

Domain Renewal

We will send renewal reminders one month before your domain’s expiry. We are not responsible for any failures or delays in domain renewal. Once renewed, no refunds will be issued.

 

Free Domain Offer

A free domain is included with the highest hosting plan and all cloud hosting plans. The free domain is only for the first year; renewal charges apply from the second year. This offer applies to selected domain extensions and is subject to change. We reserve the right to approve or decline free registrations or transfers. Additional charges apply for extensions not covered by this offer.

 

Backup Policy

User Responsibility

You are responsible for backing up all content used in your hosting services. HostPatch does not guarantee backups of any user content, and you accept the risk of data loss.

Liability Disclaimer

HostPatch is not liable for any data loss under any circumstances.

Backup Frequency

Daily backups are included with cloud hosting plans, retaining database backups for 7 days and weekly website backups for 1 day. Backups will not include emails or media files.

Paid Backup Solutions

We recommend considering our paid backup solutions for VPS and Dedicated Servers.

 

Service Uptime

We aim for a service uptime of 99.9%, excluding planned maintenance or unforeseen circumstances. Customers will be notified in advance of scheduled maintenance via email. In case of server issues, a qualified engineer will respond within 30-60 minutes of notification. If the issue persists, you will be updated with details and an estimated resolution time via your registered email.

 

Uptime Commitment

  1. Scheduled maintenance by HostPatch or its network partners will not affect the uptime guarantee.
  2. HostPatch disclaims liability for disruptions caused by third-party services.
  3. HostPatch is not accountable for failures due to external circumstances, such as natural disasters, governmental actions, or service interruptions from third parties.

 

Service Suspension Conditions

  1. Service disruptions may occur due to technical issues or inactivity notifications.
  2. Changes in law or regulations may prompt service updates.
  3. Modifications requested by you may also lead to service changes.
  4. Legal obligations may require service adjustments.
  5. Breach of material terms can lead to service suspension.
  6. Actions or claims from third parties may also result in service changes.
  7. To mitigate financial or legal risks, services may be suspended.

 

Refund Policy

  1. Our money-back guarantee varies by service; on Web Cloud and WordPress Cloud hosting plans include a 30-day guarantee, while monthly plans have a 3-day guarantee.
  2. Refunds will exclude VPS, Servers, any licenses, domain registration fees. No refunds apply to domains, renewals, or licenses.

 

Payment Guidelines

  1. Payments via credit/debit cards, net banking, UPI, and PayPal enable immediate account activation; bank transfer require 1-2 working days for processing.
  2. The money-back guarantee only applies to initial subscriptions; subsequent accounts do not qualify.
  3. Refunds exclude charges for domain registrations, licenses, and various fees.
  4. Changes in licensing fees by software providers will affect your account pricing immediately.
  5. Services that are suspended or terminated are not eligible for refunds.
  6. Refund amounts will deduct any standard domain charges for included free domains.
  7. Transferring free domains incurs a fee.
  8. To cancel services, submit a request through the client area.
  9. Refund processing may take up to 14 days.

 

Late Payments

  1. Failure to pay invoices may result in service suspension or account termination until outstanding balances are cleared.
  2. Terminated accounts will lose access and data, requiring a new account setup.
  3. Customers with unpaid balances cannot activate new services.

 

Promotional Pricing

  1. HostPatch offers diverse products and transparent pricing.
  2. Promotions apply only to new customers for the initial term, reverting to standard rates for renewals.

 

Tax Information

All prices exclude taxes. Click “add to cart” for tax-inclusive pricing. Tax amounts are non-refundable, applicable only for Indian clients.

 

Cancellation Procedure

  1. To cancel services, submit a request through your client area after settling dues.
  2. Choose between immediate or expiration-based cancellation; immediate cancellation results in service loss.
  3. Backup all data prior to cancellation to avoid permanent loss.

 

Account Termination

Possible reasons for account termination include:
– Your request.
– Expiration cancellations.
– Non-payment of fees.
– Delayed renewals.
– Breaches of service terms.
– Potential fraud concerns.
– Disputes or chargebacks.
– Data backup is recommended to prevent loss.

 

Invoice Disputes

Account Security

  1. You are responsible for maintaining your account’s security and preventing unauthorized access.
  2. Protect your password and avoid sharing it.
  3. Unauthorized access attempts may lead to termination.
  4. Ensure that all programs/scripts are secure and permissions are properly set. Weak passwords could lead to account suspension until they are strengthened.
  5. We reserve the right to monitor our systems for compliance.
  6. Unauthorized connections to third-party networks may result in suspension.
  7. Compromised accounts will be disabled, with clean-up potentially incurring fees.
  8. We may migrate accounts between data centers without notice.

 

Indemnity

Customers agree to indemnify HostPatch for losses, claims, and liabilities arising from services or products sold, including personal injury, property damage, and copyright infringement.

 

Liability Limitations

  1. HostPatch is not liable for any direct or indirect damages resulting from uncontrollable events.
  2. Liability is limited to fees paid in the previous twelve months for the respective services. Jurisdictions may vary on liability limits.

 

Dispute Resolution

  1. The Courts of Prayagraj, Uttar Pradesh, hold exclusive jurisdiction for disputes under this agreement.
  2. Indian laws govern this agreement.

 

Pricing Adjustments

Pricing may change periodically based on vendor adjustments. Regular review of your billing details is advisable to anticipate any price increases.

 

Change of  TOS

  1. HostPatch may modify these Terms of Service (TOS) at any time, with immediate effect. If changes are required by law, involve new services, or add functionality without affecting your rights or responsibilities, no prior notice will be given.
  2. No clarifications or explanations by either party will alter these TOS provisions.
  3. By signing up for HostPatch’s services, you agree to the TOS, Privacy Policy, and any other applicable regulations set by HostPatch.
